1. Service Provider Identity

2. Purpose

These General Terms and Conditions (GTC) define the conditions under which Mogup provides real-estate-related services, including in particular:

  • Introductions / brokerage between sellers and buyers, and between landlords and tenants,
  • Support and assistance (viewings, lead qualification, file preparation, coordination),
  • Marketing and commercialization (listing distribution, marketing, prospecting), under the terms agreed with the client.

3. Scope of Application

These GTC apply to any service ordered from Mogup (prospect, owner, landlord, seller, tenant, buyer).

In the event of any contradiction between a signed mandate/contract and these GTC, the signed document shall prevail.

4. Definitions

  • Client: any individual or legal entity requesting a Mogup service.
  • Mandate / Agreement: a written document (or formalized exchange) defining the assignment, duration, scope, and fees.
  • Fees / Commission: Mogup’s remuneration due in the event of success (sale/rental) or under specific conditions defined in the mandate.

5. Order Formation (Acceptance of Assignment)

The assignment is deemed accepted when one of the following occurs:

  • signing of a mandate/agreement,
  • written acceptance (email/WhatsApp) of a quote/terms,
  • or performance of the service at the client’s express request (e.g., launching advertising, organizing viewings).

Mogup may request the information/documents required before execution (title deed, authorizations, ID documents, supporting documents, etc.).

6. Fees & Pricing

Unless specific terms are provided in the mandate/agreement, Mogup’s fees are:

A) Sale

Sales commission: 2.5% to 3% of the sale price.

B) Long-term rental (≥ 12 months)

1 month of rent (excl. tax) paid by each of the two parties (tenant and landlord).

C) Short-term rental

  • 3 months: 25% (excl. tax) of the monthly rent (per party)
  • 6 months: 50% (excl. tax) of the monthly rent (per party)

Important notes:

  • Excl. tax” means excluding taxes. Applicable taxes (if any) are added in accordance with regulations.
  • Fees become payable upon completion of the transaction (signing of deed/contract, or any equivalent agreement formalizing the transaction), unless otherwise stated in the mandate.

7. Payment Terms

Payment methods (bank transfer, cash, etc.) are specified on the invoice or in the mandate/agreement.

Unless otherwise stated, invoices are payable upon receipt.

8. Late Payment — Penalties & Collection

In case of late payment:

  • Late payment interest: 1.5% per month
  • Fixed collection fee: 200 MAD

Any month started may be considered due. Additional collection costs (bailiff, legal proceedings) may be claimed if incurred.

9. Client Obligations

The client undertakes to:

  • provide accurate and up-to-date information,
  • provide the required documents (and authorizations) enabling marketing and/or rental/sale,
  • not conceal any material information (legal status, unavailability, dispute, easement, etc.),
  • comply with agreed appointments and logistical conditions (viewings, property access).

10. Mogup Obligations

Mogup undertakes to:

  • use reasonable means to carry out the assignment (prospecting, distribution, qualification, coordination),
  • inform the client of meaningful feedback and serious opportunities within the agreed scope,
  • keep transmitted information confidential, unless legally required or authorized by the client.

11. Cancellation / Interruption of Assignment

Unless otherwise stated in the mandate/agreement:

  • The client may request termination of the assignment in writing.
  • Costs already incurred (e.g., paid advertising, photo shoots, specific travel, outsourced services requested by the client) may be re-invoiced upon supporting documentation.
  • If the transaction is concluded with a contact introduced by Mogup during the assignment (or during a “post-assignment” period defined in the mandate), fees remain due.

12. Liability (Limitations)

Mogup acts as an intermediary and/or support provider:

  • Mogup does not replace the notary, administration, surveyors/diagnostics, banks, or technical experts.
  • The final decision (purchase, rental, price, terms) belongs to the parties.
  • Mogup cannot be held liable for information provided by the client if it is inaccurate or incomplete.

13. Force Majeure

No party shall be held liable in the event of delay or non-performance due to a force majeure event (major breakdown, disaster, administrative restrictions, etc.) making performance impossible.

14. Complaints / Customer Service

Any complaint must be sent by email to Contact@mogup.immo.

Mogup will do its best to respond within a reasonable timeframe depending on the complexity of the case.

15. Personal Data

Data processing is described in the Privacy Policy (retention periods, rights, security, etc.).

16. Changes to the GTC

Mogup may amend the GTC. The applicable version is the one in force on the date of the order/service, unless otherwise agreed in writing.

17. Governing Law & Disputes

These GTC are governed by Moroccan law.

In case of dispute, the parties will seek an amicable solution first. Failing that, the territorially competent courts shall have jurisdiction.
